TERMS OF SERVICE AGREEMENT
Scoop Doggie Dog Pet Waste Removal
Wake County, North Carolina
This Terms of Service Agreement (“Agreement”) governs all services provided by Scoop Doggie Dog Pet Waste Removal (“Company,” “we,” “us,” or “our”). By scheduling, enrolling in, or receiving services, the client (“Client,” “you,” or “your”) agrees to the following terms:
1. Scope of Services
The Company agrees to provide pet waste removal services at the service address designated by the Client. Service frequency, pricing, and scope shall be agreed upon at enrollment. The Company reserves the right to modify routes and service days as necessary.
2. Access & Property Conditions
Client shall ensure safe, unobstructed access to the property on scheduled service days. All pets must be secured prior to arrival. Gates must be unlocked and fully operational.
If access is denied or the property is inaccessible, the scheduled service will be considered completed and the full service fee may be charged.
Client warrants that the property is free from hazardous conditions including, but not limited to: aggressive animals, exposed wiring, dangerous debris, sinkholes, or unsafe terrain.
3. Assumption of Risk
Client acknowledges that pet waste removal involves inherent risks. Client agrees that Company shall not be liable for injuries to pets caused by pre-existing health conditions or environmental hazards present on the property.
4. Limitation of Liability
To the fullest extent permitted by North Carolina law:
- Company shall not be liable for indirect, incidental, special, or consequential damages.
- Company’s total liability for any claim arising out of services shall not exceed the amount paid by Client for services in the thirty (30) days preceding the claim.
- Company is not responsible for pre-existing property damage, landscaping damage due to concealed hazards, or pet escapes resulting from defective fencing or gates.
Client is responsible for ensuring fencing and gates are secure and in proper working order.
5. Sanitation & Biosecurity
Company disinfects tools and footwear between properties; however, Client acknowledges that no sanitation process eliminates all potential biological risks. Company shall not be liable for the transmission of parasites, bacteria, or viruses that may exist in outdoor environments.
6. Weather & Force Majeure
Services may be delayed due to severe weather, acts of God, natural disasters, governmental actions, or other circumstances beyond Company’s control. Missed services due to such events may be rescheduled at Company’s discretion.
7. Payment Terms
Payment is due in accordance with the billing schedule selected by Client. Failure to remit payment may result in suspension or termination of services.
Returned payments, chargebacks, or declined transactions may incur administrative fees. Client agrees to pay all reasonable collection costs, including attorney’s fees, if applicable.
8. Cancellations & Termination
Client may cancel service with written notice prior to the next scheduled visit. Same-day cancellations may result in a service charge.
Company reserves the right to terminate service immediately for:
- Non-payment
- Unsafe conditions
- Threatening behavior
- Repeated access issues
9. Indemnification
Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and contractors from any claims, damages, liabilities, or expenses arising from:
- Conditions of the property
- Client’s breach of this Agreement
- Injury to persons or animals on the property
10. Dispute Resolution
This Agreement shall be governed by the laws of the State of North Carolina. Any disputes arising from services shall be resolved in the appropriate courts located within Wake County, North Carolina.
11. Modifications
Company reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of updated terms.
By engaging services, Client acknowledges that they have read, understood, and agree to be bound by this Agreement.
